HOME WARRANTY PROGRAM - ECH BUILDERS LLC

ECH BUILDERS LLC (ECH) and the local building department have inspected your home to ensure that all current code requirements are met, and that everything in your home is in working order. From the date of closing on your home ECH warrants the home against defects in material, workmanship, and defects in major systems for a period of one year.
You will have two opportunities to address any defects in your new home.

Your first opportunity will be at your Pre-close Orientation walk through.
At your Pre-close Orientation walk through a representative of ECH will assist you in preparing a detailed list of any damages or defects that exist at that time. ECH will repair any defects in a reasonable time frame.
Please take the time to carefully inspect your unit during this walkthrough. Claims for damages such as paint and drywall scars, scratches in woodwork, damages or stains in flooring, rips in screens, scratches or dents in doors and appliances, scratches or damage to cabinets, vanities, countertops, sinks, faucets, tubs, showers, and toilets will not be honored if discovered after this inspection.
In summary, cosmetic damages to any and all surfaces of your unit must be identified during this walkthrough. Defects in the building structure, mechanical systems, and appliances in your unit are under warranty according to the terms of the General Warranty.

Your second opportunity will be at
eleven months after your closing date.
Enclosed is an Eleven Month Punch list that you will need to fill out at that time. Please mail this punch list to ECH Builders LLC, PO Box 6376, Nashua, NH 03063-6376 prior to your one-year anniversary from your date of closing. Please insure that this punch list is post dated prior to your one-year anniversary. Punch list received after your one-year anniversary of your closing will not be honored. A representative of ECH will contact you within thirty days from receipt of your Eleven Month Punch list to schedule any necessary repairs.

GENERAL LIMITED ONE YEAR WARRANTY
|
ECH BUILDERS LLC (ECH) in its continued effort to provide service to its customers is providing this limited warranty for a period of one year from the date of Closing on the unit. The intent of this program is to correct defects discovered in materials and workmanship.
It is important to understand that this program is not a maintenance program, and that maintenance is the responsibility of the buyer.
ECH recommends that you do not wallpaper or use any wall coverings during your first year of occupancy. During that year it is common to have nail pops, and or seam and stress cracks in your wall surfaces, these repairs if needed will be addressed in your eleven-month checklist. ECH will not be responsible for repair or replacement of wall coverings or special paints. Walls will be repaired back to the original surface condition and color that was in place when you closed on your home.
ECH also suggests that you wait one year to make any improvements to your garage storage as a precaution in case of leaks or moisture. Make it a point to place items in your basement on pallets or wood to insure that in the event of a leak your personal property is not damaged. ECH will not be responsible for the repair or replacement of basement improvements and personal property stored in this area.
ITEMS COVERED UNDER THIS WARRANTY:

| Structural |
ECH warrants your home against major structural defects. A major
structural defect is actual physical damage to the following load bearing components of your home that affects such components ability to perform its load bearing function in the home to the extent that the home becomes unsafe, unsanitary, or unlivable. Settling of structural components causing cracking to interior surfaces does not constitute a reason to replace such components. The following are examples of structural components
1. Foundations and footings
2. Beams
3. Girders
4. Lintels
5. Load Bearing Columns
6. Load bearing walls and partitions
7. Floor joist & floor systems
8. Roof framing systems

| Foundation: |
ECH warrants your foundation against structural defects that would affect its ability to support your homes structure. ECH also warrants your basement to be free of standing water due to seepage through your concrete foundation. Water caused by condensation and moisture is not covered under this warranty. Concrete by nature shrinks and cracks and these cracks will not affect the integrity of your foundation, and do not need to be repaired. Should any crack allow water to seep into the basement it will be repaired.

| Basement & Garage Slabs: |
ECH warrants your concrete slabs against structural defects that would affect its ability to support your personal property, or in the case of garage under units its ability to support an automobile. Concrete by nature shrinks and cracks and these cracks will not affect the integrity of your slabs and are not covered by this warranty. All slabs will by nature have varying degrees of finishes and elevations and these changes are not covered by this warranty.

| Electrical: |
ECH warrants all electrical wiring, switches, light fixtures, circuit breakers, and exhaust fans in your home. Light bulbs are not warranted. Ground fault interrupters protect your bathrooms, kitchen and exterior outlets. (GFI's) Should you lose power in these areas please check your GFI's for resetting.

| Plumbing: |
ECH warrants all plumbing, water piping, and waste piping in your new home. Your piping system has been completely tested for leaks and blockages. Blockages and leaks in your system are considered emergency repair items, due to the fact that serious damage to your home can occur if left un-repaired. Obvious leaks left un-repaired by the Buyer that cause damage to other components of the home will be charged as a service call to the buyer, and be billed at industry rates. Blockages in waste lines caused by the buyer will also be charged as a service call.
Please call the appropriate subcontractor to report defects in your plumbing system. If you do not receive immediate service feel free to call ECH directly.

| Heating: |
ECH warrants all the heating equipment in your new home. This includes your hot air furnace, and its associated ductwork, the hot water tank, and the air circulator if applicable. ECH is not responsible for general maintenance such as air filters in your furnace, and for periodic draining of sediment from your hot water tank. Please call the appropriate subcontractor to report defects in your heating system. If you do not receive immediate service feel free to call ECH directly.

| Air Conditioning: |
ECH warrants the air conditioning system in your new home. This includes your condenser unit and its associated Freon piping, along with your air conditioning coil in your furnace. ECH is not responsible for general maintenance of your air conditioning system. Freon levels in your system need to be checked periodically, along with the cleaning of dirt and debris from the condenser unit. Please call the appropriate subcontractor to report defects in your air conditioning system. If you do not receive immediate service feel free to call ECH directly.

| Drywall: |
During the first three to six months contraction and settling of your home will occur, which will cause cracks and nail pops to occur. ECH will repair these defects once during the one-year warranty period. ECH suggest that these repairs be completed during your eleven-moth punch list so that we may be assured that all the settlement has occurred Please note that we will attempt to match existing colors to the best of our ability. Paint repairs are the responsibility of the homeowner as stated earlier in this warranty ECH cannot be held responsible for wall coverings, custom paints, and any homeowner installed items when repairing drywall.

| Flooring: |
ECH warrants your homes flooring from manufacturers defects and installation defects. As stated previously, all scratches, dents, stains, and basically any cosmetic damages to your flooring must be identified during your pre-close walk through.
Your flooring requires daily maintenance to keep it looking good, and protect it from damage and excess wear. ECH will not be responsible for normal wear and tear, soiling and staining caused by the buyer, and damage caused by pets. Please understand that wear patterns will occur in high traffic areas.
All repairs to flooring will be completed as a patched area. Repairs will not constitute a replacement of an entire room of flooring. Please understand that repairs to flooring sometimes does leave minor seams and should only be visible to the eye that knows that a patch exist.

| Appliances: |
Appliances are warranted from the manufacturer, and you should refer to your manual and contact the appliance supplier should you have a problem.
|
| Exterior: |
ECH warrants the exterior components of your new home. These components are siding, landscaping, walkways, parking areas, and decks. Please understand that the unit owner must perform normal maintenance to your limited common deck areas. Damage caused to your deck areas can be charged to you if proper maintenance was not performed.

| Fire Sprinklers: |
ECH warrants your fire sprinkler system from any defects during the one-year warranty.
Your fire sprinkler system is fully automatic and will open if a fire starts in your home. ECH is not responsible for any damage caused by water from a sprinkler system due to the buyer's negligence to report any leaks, and / or damage caused to piping or sprinkler heads by the home owner.
Leaks in your sprinkler system are considered emergency items and need immediate attention.
Please call the appropriate subcontractor to report defects in your fire Sprinkler system. If you do not receive immediate service feel free to call ECH directly.

| ECH Installed Options & Upgrades: |
ECH warrants all options & upgrades according to the terms of this Limited Warranty. Should defects occur in any options please contact the appropriate subcontractors or ECH for repairs

ITEMS NOT COVERED UNDER THIS WARRANTY:

1. Defects in appliances or equipment that are covered by manufacturers warranties.
2. Damages due to ordinary wear and tear, abusive use, misuse, or lack of proper
maintenance of the buildings components or systems.
3. Defects in items installed by anyone other than ECH.
4. Damage caused by ants or insects of any type.
5. Cosmetic damages not included in the pre-closing walk through such as cracks, chips, scratches, cuts, or breaks in drywall, flooring, windows, screens, plumbing fixtures, cabinets, vanities, counters, woodwork, paint, doors, door knobs, and appliances
6. Loss, damage or injury due to natural elements.
7. Normal items covered by the Association insurance or the Homeowners insurance.
8. Municipal or public utility services.

SEVERABILITY:

In the event that any provisions of this Limited Warranty shall be deemed invalid, the remainder or the provisions of this Limited Warranty shall remain in full force and effect.
